- Data We Collect Automatically: Device ID/Interaction Information.
MonicaMichelle Boutique and our third-party business partners, including service providers, analytics providers, advertisers, communication services providers, and third-party content providers, may automatically or passively receive and record certain data about your use of the Channels whenever you visit or interact with the Channels (" Device ID/Information") This information helps us create a better experience for our users and provide you with targeted advertising. Please see the "Third Party Advertising and Analytics/Privacy Controls" section below for more information about how to control the use of your personal data for the purposes of advertising. Device ID/Information may include, but is not limited to:

- Session Replay Technology
MonicaMichelle Boutique may record through session replay technology your interactions with the Channels, such as what pages you visit on the Channels, how long you visit those pages, and any links you click or information you provide. We use this data for our internal business purposes, such as for website analytics, to improve the Channels and our products and services, and to address functionality issues.

- Community Forums and User Submissions.
The Channels may provide you the opportunity to submit information to us, through interactive features, and through other communication functionality (" Community Forums"). Photos and Videos. We allow you to post photos and videos on the Channels or to submit them to us as described in the chart above. Applicable laws and regulations may vary with respect to whether such materials are considered to be biometric information. For clarity, MonicaMichelle Boutique does not create a record of facial geometry from your photos or videos, and does not use your photos or videos for the purposes of facial recognition, facial surveillance, or otherwise as a biometric identifier. Please note, however, that to the extent that you post your photos or videos publicly on our Channels, or we share – as described elsewhere in this Privacy Policy – such materials with third parties who are permitted to use these materials in accordance with their own privacy policies, we do not control the actions of third parties, and their use of your photos or videos may differ from ours.
- Social Networking Features.
Functionality on the Channels may permit interactions between the Channels and a third-party service such as Facebook or Instagram ("Social Networking Features"). Examples of Social Networking Features include enabling you to "like" or "share" content from the Channels or to "like" or "share" our content on a third-party service; to automatically or selectively show your social media posts on the Channels; and to otherwise connect the Channels to a third-party service. If you choose to share content or to otherwise post information through the Channels to a third-party service, or vice versa, that information may be publicly displayed. In addition, the third party service may set their own cookies and collect data about your use of the Channels, including your IP address or other device identifiers, and which pages you visit on the Channels. These third party platforms may be able to collect certain data on your visits to the Channels regardless of whether or not you affirmatively interact with the feature and whether or not you are logged into (or have) an account with the third party platform. If you are logged out or do not have an account and visit a page with a social plug-in, your browser sends a more limited set of information. The data we collect in connection with Social Networking Features is subject to this Privacy Policy. If you submit User Submissions or use Social Networking Features, we may publish that information or content online or offline, including in connection with our advertising, marketing, publicity, and promotional activities, as further described in our Terms of Use or additional terms that you may agree to before submitting a User Submission.
- Chat Boxes.
When you participate in our Live Chat feature, MonicaMichelle Boutique can record and use your communications and the information you provide to assist you during the Live Chat session, to provide customer service, improve our products and services, and for marketing. If you do not consent, please do not continue with chat assistance.
- Sweepstakes, Contests, & Promotions.
We may offer sweepstakes, contests, and other promotions (any, a "Promotion") that may require registration. By participating in a Promotion, you are agreeing to the provisions, conditions, or official rules that govern that Promotion, which may contain specific requirements of you (including, except where prohibited by law, allowing the sponsor(s) of the Promotion to use your name, voice, likeness or other indicia of persona in advertising or marketing materials). - Enhancement Data and Other Information.
We may receive data about you from third parties, such as data aggregators, joint marketing partners, third party websites, affiliate programs, service providers, the bank that operates our private label credit card, users who provide us with data about others (i.e. purchasing a gift card for someone else), or other unrelated third parties. We may also supplement the data we collect with outside records from third parties, such as public databases, publicly available social media pages, and third parties who enhance the data we have about you, in order to provide you with information, services or products you have requested, to tailor content, to offer you opportunities to purchase products or services that we believe may be of interest to you, and for other purposes. Please note that if you apply for or utilize a branded credit card from one of our brands, you are providing your data to the bank that administers the credit card, which will share certain data with us. We may combine information about you that we have with data we obtain from third parties. In those cases, we will apply this Privacy Policy to the combined data. The data collected and stored by third parties is subject solely to the third party’s privacy practices.
- Send-to-a-Friend Features.
We may make available on the Channels a "send-to-a-friend," "refer a friend," "wishlist" or similar function that permits you to send Channel content directly to a third party through the Channels. If you send a friend a communication using such functionality, the information you provide about your friend (e.g., name and e-mail address) is used to facilitate the communication and is not used for any other marketing purpose unless we obtain consent from that person. - Data We Disclose to Third Parties.
We may share non-personal data, such as certain Device ID/Interaction Information, hashed or otherwise de-identified or pseudonymized data, and aggregated user statistics, with third parties in our discretion and as permitted by law, including for targeted advertising purposes. We may share the data we have collected about you (including personal data) in the circumstances described below or elsewhere in this Privacy Policy, as disclosed at the time you provide data, or otherwise with your consent.
- Other Cobranded Partners.
Cobranded partners are entities with whom we work to offer a service or feature. You can typically tell when you are accessing a service offered by a cobranded partner because the cobranded partner’s name will be featured prominently. You may be asked to provide information about yourself to utilize a feature offered by a cobranded partner. In doing so, you may be providing your information to both us and to the cobranded partner, or we may share your data with the cobranded partner to allow you to participate in the feature. - Google Analytics.We use Google Analytics, which use cookies and similar technologies to collect and analyze information about the use of the Channels and report on activities and trends. This service may also collect information about the use of other websites, apps, and online services. - Loyalty Program Disclosures
We provide a loyalty program which provides you with loyalty benefits such as points on your eligible purchases that are redeemable for credit on your purchases, access to exclusive offers, and the ability to maintain wish lists and your order history. This program is subject to termination at any time at our sole discretion.
Through our loyalty program, we process the following personal data: membership number; points accrued as a loyalty program member; data related to redemption of loyalty points and/or certificates, date of birth ("Loyalty Program Data"). Loyalty Program Data is personal data that would not be collected, processed, sold, or shared if you were not a member of the StyleRewards program. This section discusses our practices in relation only to Loyalty Program Data. We may collect, process, sell, and share other personal data of members and non-members alike, including for targeted advertising, as set forth in other sections of this Privacy Policy.

The loyalty program does not include loyalty program partners, which is defined as an unaffiliated third party who offers benefits to a company’s loyalty program members. However, the following third parties may receive Loyalty Program Data: advertising and analytics partners, technology systems service providers, security vendors, and other service providers who use your data solely to provide services to us or to you.
Impact of Deletion of Personal Data: If you are a MonicaMichelle Boutique member who is eligible to and chooses to exercise your right to delete your personal data, then your loyalty program account, including the unique membership identification number, any accrued points associated with the account, your contact information, and any other information tied to your membership account will also be deleted. There is no benefit of the loyalty program that can be extended to you after the deletion of your personal data.
- Our program is based on points which accrue to your unique membership identification number based on your purchases. Points are debited based on your point redemptions and returns. Without the ability to relate and track your transactions to the membership identification number that will be deleted as a result of your deletion request, we will be unable to add or deduct points based on your transaction activity, or access any previously accrued points.

- Once your unique membership identification number is deleted from our systems, we will be unable to recognize your membership identification number to provide you with access to your order history, wish lists, and other member-only benefits that we may offer from time to time.

All registered users of a Channel have the right to request the removal of certain content that (they have publicly posted on the Channel. A user can request that we remove content (s)he has previously posted by contacting us using the information listed in the "Contact Us" section below. When submitting a request, please be sure to include your full name, email address, and information sufficient to permit us to locate the User Submission(s) for which you are requesting removal (e.g., for product reviews, a URL of the product page and the username under which you posted your review). In some cases, we may remove only your personal data, but maintain the rest of your User Submission. Note that any removal of your public postings in accordance with these procedures does not ensure complete or comprehensive removal of the content or information you posted, which may persist in archival records or may have been copied by third parties while publicly accessible. - Authorized Agents Submitting Opt-Out Requests for Sales and Targeted Advertising (CO and CT Residents) – If you are an authorized agent submitting a request to opt-out of sales or targeted advertising on behalf of a Colorado or Connecticut resident, please submit the request pursuant to the above instructions. We process Personal Data for the purposes set out above in our Privacy Policy. Our legal basis to process Personal Data includes processing that is:

In your request, you must provide enough information to allow us to verify you are the person about whom we collected personal information, or their authorized representative. You must also describe your request with enough detail so that we can understand, evaluate, and respond to it. We can’t respond to your request if we can’t verify your identity. Making such a request does not require you to create an account with us, and we will only use the information you provide in a request to verify your identity.
Verifying Your Requests
We will take reasonable steps to verify your identity based upon the information you provide and the type of request you are making.
When you exercise your Right to Know, Right to Delete, and/or Right to Correct, we may ask that you provide us with information, beyond your full name, to verify your identity and fulfill your request. If we are unable to verify that the individual submitting the request is the same individual about whom we have collected information (or someone authorized by that individual to act on their behalf), we will not be able to process the request.
Agents
If you are an authorized representative submitting a request on a user’s behalf, please complete the applicable request per the instructions below.. Alternatively, you may submit a copy of a power of attorney under Probate Code sections 4000-4465. In either case, please also indicate in your email the nature of your request. The consumer’s identity, in addition to your own, will need to be independently verified for us to fulfill your request. We may also ask the consumer to directly confirm with us that they provided you permission to submit a request. Please keep in mind that if we do not receive adequate proof that you are authorized to act on the consumer’s behalf, we may deny the request.

Right to Limit the Use and Disclosure of Sensitive Personal Information
Under the CPRA Regulations, a business must only provide the Right to Limit the Use and Disclosure of Sensitive Personal Information when such use is not collected or processed for the purpose of inferring characteristics about a consumer, or does not fall under certain statutory exceptions, pursuant to CPRA §1798.121. MonicaMichelle Boutique's use and disclosure of Sensitive Personal Information is not used for such purpose and/or falls within the statutory exceptions, and we therefore do not offer this right at this time.
Data Retention
MonicaMichelle Boutique will not retain Personal Information for longer than is reasonably necessary for each disclosed purpose outlined in this California Privacy Notice and our Privacy Policy, and as otherwise needed to address tax, corporate, compliance, litigation, and other legal rights and obligations. MonicaMichelle Boutique retains all categories of personal information described in this California Privacy Notice: (1) for as long as you have an account with us and while you continue to use or visit any of the Channels; or (2) for as long as it is reasonably necessary for the purposes set out in this Privacy Policy, considering the time period reasonably necessary to provide the Channels and our services to you; exercise the choices and rights you have requested; comply with our contractual obligations; enforce our terms for use of the Channels; and comply with legal and regulatory requirements.

Under California regulation, certain aspects of our loyalty and similar programs, which provide benefits to consumers, may be considered a financial incentive program. We collect personal information from you in connection with our loyalty program, e.g. contact information (name, email address, residential address) and commercial information (like purchase history) for a number of reasons, including to administer the program, contact you with regard to your account (if any), to provide the benefits to you, to better serve you, and to fulfill your requests associated with the program.
